Terms of service

Terms of service

These terms govern your use of ernestotter.com and any order you place through it. Please read them before ordering. By placing an order you accept them.

1. Who we are

ernestotter.com is operated by ELYSIUM SERVICES LLC, trading as Ernest & Otter, 30 North Gould Street, Ste R, Sheridan, WY 82801, United States.

Email: contact@ernestotter.com · Telephone: +33 6 37 24 99 47

2. Prices

All prices are shown in pounds sterling and include VAT where it applies. Delivery to the United Kingdom is free, with no minimum spend, so the price shown on the product page is the total you pay.

We may change prices at any time, but a change never affects an order you have already placed and paid for.

If a product is listed at an obviously incorrect price through an error on our part, we will contact you before dispatch and you may either confirm the order at the correct price or cancel it for a full refund.

3. Orders

Your order is an offer to buy. A contract is formed when we send you a dispatch confirmation, not when you pay. If we cannot fulfil your order we will tell you and refund you in full.

We may decline an order where the product is unavailable, where we cannot deliver to your address, or where we reasonably suspect fraud.

4. Delivery

We deliver to the United Kingdom only. Orders arrive within 10 to 15 working days. Full details are in our delivery policy.

Goods remain our responsibility until they are delivered to you.

5. Cancellation and refunds

You may cancel within 14 days of receiving your order, for any reason. Every request must include your order number and clear photographs of the item as received. We may ask you to return the item; where we do, we arrange the return and cover its cost, and the item must come back in a resaleable condition in its original packaging. We refund to the original payment method within 14 days of receiving it back or of proof of postage. Faulty goods may be rejected within 30 days for a full refund, and we cover the return cost in that case. We may decline repeated, incomplete or manifestly abusive requests, without affecting your statutory rights. Full details are in our refund policy.

6. Product descriptions and images

We describe our products as accurately as we can. Photographs are representative; colours vary between screens, and wood is a natural material, so grain and tone differ from piece to piece. Dimensions are given on each product page and are accurate to within normal manufacturing tolerance.

7. Age and supervision

Our products are intended for children and are sold to adults. Some items contain small parts. Please read any assembly instructions and age guidance supplied with the product, and supervise young children during play.

8. Intellectual property

The Ernest & Otter name, logo and the text of this website belong to us and may not be reproduced without permission.

9. Our liability

We do not exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud, and for any breach of your statutory rights as a consumer.

Subject to that, we are not liable for losses that were not foreseeable, or for business losses, as we supply to consumers rather than for commercial use.

10. Your statutory rights

Nothing in these terms affects your legal rights. If you are a consumer in the United Kingdom, you have rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 that cannot be signed away. Where anything in these terms conflicts with those rights, those rights apply.

11. Complaints

Email contact@ernestotter.com and we will acknowledge within 2 working days and aim to resolve within 14 days.

12. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland, you may bring proceedings in your own jurisdiction. This does not deprive you of the protection of any mandatory consumer law that applies where you live.

13. Changes

We may update these terms. The version that applies to your order is the one published when you placed it.
